TIOGA COUNTY CONSERVATION DISTRICT
EROSION AND SEDIMENT POLLUTION CONTROL PLAN REVIEW FEE SCHEDULE
Effective April 15, 2010
The Tioga County Conservation District will charge the following fees for Erosion and Sedimentation Control Plan Reviews as authorized by Act 217, The Conservation District Law. Plan Requirements are applied as per DEP’s Chapter 102, Erosion and Sediment Control Regulation 102.4(b)(2)(i), which states, in part, any earthmoving activity which disturbs at least 5,000 square feet requires a written Erosion and Sediment Control Plan.
Subdivisions – Residential
$ 100 per lot plus assessment for disturbed area greater than ½ acre.
*Disturbed areas included any and all disturbed land such as roadways, utilities, etc. which are necessary for site development.
0.5 – 1.99 acres $ 150.00
2 – 4.99 acres $ 350.00
5 – 9.99 acres $ 550.00
10 – 14.99 acres $ 750.00
15+ acres $ 750.00 plus $ 40.00 per acre over 15 acres
(Townhouses, Apartments, and Trailer Park fees will be based on Industrial/Commercial Rates)

NPDES Administrative Filing Fees
NPDES General $ 500.00
NPDES Individual $ 500.00

Minor Modification Fee
Minor modifications to an approved erosion and sediment control plan will be assessed at $40.00 per hour with a one hour minimum.
Additional Fees and Procedures
- If a permit application is administratively incomplete the Conservation District will retain the administrative filing fee and a new administrative filing fee will need to be submitted upon application resubmittal.
- When plans fail to address deficiencies as determined by the Conservation District a charge of 50% of the original review fee will be imposed for the third submission and each submission thereafter until the plan meets the requirements of Chapter 102.
- All fees are non-refundable upon the Districts initiation of the plan review.
- Applications containing major errors or deficiencies will be returned to the applicant without District review and a new set of review fees shall be included when resubmitted.
- Major modifications to approved plans or permit packages will require a new set of fees be submitted.
- PA State Governmental agencies are exempt from both administrative filing fees and E&S review fees.
- An E&SPC plan will be considered complete for review when the District receives a completed application form (not required for NPDES permit applications), a check made payable to the Tioga County Conservation District in the amount of the appropriate fee, copies of the plan drawings and the erosion and sediment control plan narrative as required to define the proposed activity.
- A permit application for an NPDES General or NPDES Individual must include a separate check payable to the Tioga County Clean Water Fund in the amount of the appropriate administrative filing fee in addition to the appropriate E&SPC plan review fee.
- A $25.00 charge will be assessed for any check refused by the bank due to insufficient funds and the application package will not receive review.
- E&SPC Plans will be reviewed within 30 business days of receiving a complete application package.
